States to Watch: Midwest States with Cannabis Bills

Indiana Cannabis Legislation

Indiana State Representative Heath VanNatter has introduced House Bill 1630, which aims to create a regulated program that permits individuals over 21 years of age to possess and consume cannabis. This legislation would establish a Cannabis Commission responsible for overseeing the industry.

The bill allows for a maximum of 300 cannabis retail licenses, ensuring that at least one is available in each of Indiana’s 92 counties. Furthermore, 15% of the available licenses would be reserved for those who qualify based on minority or veteran status. If approved, the cannabis license application process in Indiana would commence on July 1, 2025, paving the way for significant business opportunities in the cannabis sector for local entrepreneurs.

The state of Indiana legalized low-THC, high-CBD medical cannabis in 2017, through legislation, House Enrolled Act 1148, however the state failed to establish a legal state-wide regulated dispensing system for patients to get access to low-THC, high-CBD medical cannabis.

Recent polls have found a vast majority of Indiana residents support some kind of legalization. Gov. Mike Braun also says he’s open to at least some form of legalization.

Wisconsin Cannabis Legislation

The minority leader of Wisconsin’s Senate plans to introduce a medical marijuana legalization bill during this legislative session. This bill would reintroduce elements from a 2022 proposal, assigning the Department of Health Services to oversee the medical marijuana program. Previous attempts to legalize medical cannabis in Wisconsin stalled due to opposition to state-run dispensaries. However, legislators are hopeful that they can reach a compromise this session to advance Wisconsin’s cannabis legalization efforts.
