Georgia: A big step today in the push for medical marijuana in Georgia after Republican state representative Sharon Cooper filed a bill that would double the number of medical marijuana companies allowed to operate in Georgia, as well as move the Low THC Patient Registry from the Department of Public Health to the Georgia Composite Medical Board.

This comes a week after Republican Chairman Alan Powell filed a bill that would triple the number of medical marijuana companies allowed to operate in Georgia and call on the state to run its medical marijuana program in a more transparent way that would enable the community to access public records.

Tennessee: Talks about marijuana are happening again in the Tennessee state capitol. Lawmakers are set to discuss whether medical cannabis should get the green light in Tennessee. If this bill were to pass, it would set up the framework for medical cannabis in the state. This includes its use and how it is grown, sold, and moved, among other things.

The Senate Judiciary Committee is meeting Tuesday to talk about this bill.

Medical

 

Maryland: The Maryland House of Delegates approved legislation Friday that would allow voters to decide in November whether to legalize recreational marijuana use for people 21 and older.

The measure, which the Senate has not yet considered, authorizes a state constitutional amendment that would appear on the ballot for the general election. If approved, the regulatory details, such as how to tax sales, would be decided by the General Assembly and take effect in July 2023.

West Virginia: Legislation is pending in House Bill 4744, which would permit medical cannabis to be dispensed in edible form. If passed, this bill would also remove the restrictions that prevent medical cannabis from being incorporated into edible form while providing conditions related to the shape of the edible product.

Current state law only allows qualified patients in the already established medical marijuana program to possess medical cannabis in the following formulations: infused pills, oils, topicals, liquids, or dermal patches. Currently, the use of cannabis in edible form is not permitted.

South Dakota: On Monday, a South Dakota House committee defeated a Senate-passed bill to legalize marijuana. Members also gutted a separate measure that would have set up initial rules for the market by replacing it with new language to eliminate existing protections for medical cannabis patients.

Last week, the state Senate had narrowly approved the legalization bill, SB 3. But the House State Affairs Committee defeated it by voting 8-3 to move the legislation to the 41st day of the session—one day after the session ends, thereby preventing its consideration.

New Jersey: the New Jersey legal weed business could kick off as soon as next month, Gov. Phil Murphy estimated during a radio appearance Wednesday. The state’s 23 existing medical marijuana dispensaries are owned and operated by ten companies, eight of which have applied to the New Jersey Cannabis Regulatory Commission for “conversion” — to begin selling marijuana for “adult use,” a cannabis industry term referring to recreational marijuana use by any adult over 21 years old.

The commission will begin accepting applications from potential legal weed dispensary owners on March 15, but those applications will have to undergo a lengthy review process.

Vermont: 33 municipalities have “opted-in” and have retail shops for recreational marijuana use over the past two years. This year, 41 communities are looking to join.

Ted Brady, executive director of the Vermont League of Cities and Towns, thinks that most of these communities will pass the vote.

Virginia: House Republicans on Monday killed legislation intended to kick start the legal sale of recreational marijuana in Virginia, arguing that there is not enough time to perfect the complex legislation while promising to address it next year.

Virginia last year became the first state in the South to legalize possession of small amounts of marijuana, an effort led by Democrats, who then had sweeping power. Lawmakers in 2021 punted the creation of a new legal market to the current session in an effort that appeared to fail on Monday.
