Mississippi Cannabis License Update

Governor Tate Reeves signed Senate Bill 2095 into law on February 2, 2022, with the act going into effect immediately. By June 2022, MSDH planned to begin accepting online license applications. There will be a 30-day approval time for licensure applications.

Starting July 1, Mississippi will officially have a medical marijuana program, more than a year and a half after the voters overwhelmingly approved it, only to be struck down in court months later. Senate Bill 2095 was primarily a response to that decision, enshrining medical marijuana legalization into state law.

More than two dozen conditions and symptoms — including cancer, Parkinson’s, Alzheimer’s, autism, and seizures — will allow Mississippians to qualify for a medical marijuana card.

The state Department of Health began accepting applications on June 1 through their online portal, and more than 1,800 people had registered for accounts in the first six days. Department officials also said it would likely be months before businesses are licensed to sell marijuana and have had enough time to grow and test their products. The Department of Revenue will begin reviewing business applications to operate as dispensaries on July 1.

The types of cannabis business licenses that one can apply for are as follows:

 

  • Micro-cultivators: a business entity licensed and registered by the Mississippi Department of Health that acquires, grows, cultivates, and harvests medical cannabis in an indoor, enclosed, locked, and secure area.

 

  • Cultivators: a business entity licensed and registered by the Mississippi Department of Health that acquires, grows, cultivates, and harvests medical cannabis in an indoor, enclosed, locked, and secure area.

 

  • Micro-processors: a business entity that is licensed and registered by the Mississippi Department of Health that: Acquires or intends to acquire cannabis from a cannabis cultivation facility; Possesses cannabis with the intent to manufacture a cannabis product; Manufactures or intends to manufacture a cannabis product from unprocessed cannabis or a cannabis extract; and Sells or intends to sell a cannabis product to a medical cannabis dispensary, cannabis testing facility or cannabis research facility.

 

  • Processors: a business entity that is licensed and registered by the Mississippi Department of Health that: Acquires or intends to acquire cannabis from a cannabis cultivation facility; Possesses cannabis with the intent to manufacture a cannabis product; Manufactures or intends to manufacture a cannabis product from unprocessed cannabis or a cannabis extract; and Sells or intends to sell a cannabis product to a medical cannabis dispensary, cannabis testing facility or cannabis research facility.

 

  • Medical cannabis dispensary: an entity licensed and registered with the MDOR that acquires, possesses, stores, transfers, sells, supplies, or dispenses medical cannabis, equipment used for medical cannabis, or related supplies and educational materials to cardholders.

 

  • Cannabis transportation entities: independent entities licensed and registered by the Mississippi Department of Health involved in the commercial transportation of medical cannabis.

 

  • Cannabis testing facilities: an independent entity licensed and registered by the Mississippi Department of Health that analyzes the safety and potency of cannabis.

 

  • Cannabis research facilities: a research facility at any university or college in this state or an independent entity licensed and registered by the Mississippi Department of Health under this chapter that acquires cannabis from cannabis cultivation facilities and cannabis processing facilities to research cannabis, develop best practices for specific medical conditions, develop medicines and provide commercial access for medical use.

 

No individual or business entity shall have direct or indirect ownership or economic interest of greater than ten percent (10%) in:

·      More than one (1) cannabis cultivation facility license

·      More than one (1) cannabis processing facility license

·      More than five (5) medical cannabis dispensary licenses
