Nebraska Medical Cannabis Program Moves Forward Toward October 2025 Launch

Nebraska’s medical cannabis program is moving forward following voter approval in November 2024, with the state’s Medical Cannabis Commission working to finalize rules, establish licensing procedures, and prepare for the launch of a regulated marketplace. At its August 6, 2025 meeting, the commission discussed temporary regulations, potential licensing phases, and collaboration with the Nebraska Liquor Control Commission as it moves toward the October 1, 2025 deadline to begin approving cannabis business licenses. Patients, healthcare providers, and prospective business owners are watching closely as the framework for Nebraska’s medical cannabis industry takes shape.

Current Status or Background

In November 2024, Nebraska voters passed two major initiatives:

  • The Nebraska Medical Cannabis Patient Protection Act, which legalizes possession of up to 5 ounces of medical cannabis for patients with a healthcare practitioner’s recommendation.
  • The Nebraska Medical Cannabis Regulation Act, which established the Nebraska Medical Cannabis Commission to oversee licensing for cultivators, manufacturers, transporters, and dispensaries.

The commission must approve the first cannabis establishment licenses by October 1, 2025. However, the body currently lacks the ability to collect licensing fees, hire staff, or invest in necessary technology. To address these limitations, it is exploring a resource-sharing arrangement with the Nebraska Liquor Control Commission, whose members overlap by statute.

What the Bill/Program Does

The Nebraska Medical Cannabis Regulation Act directs the Medical Cannabis Commission to:

  • Approve and regulate cannabis business licenses, including cultivation, manufacturing, transportation, and dispensing.
  • Enforce product restrictions such as banning cannabis flower, flavored products, smokable/vapable products, and edibles under emergency regulations until permanent rules are adopted.
  • Ensure compliance with seed-to-sale tracking, inspections, and other oversight measures.
  • Begin approving registered cannabis establishments no later than October 1, 2025.

These measures are intended to benefit:

  • Patients who qualify for medical cannabis under the Patient Protection Act.
  • Entrepreneurs seeking to enter Nebraska’s cannabis industry.

While the Act establishes that licenses will be available for:
