New Draft of Arizona Marijuana Social Equity Program Rules

On May 6, 2021, Arizona Department of Health Services (AZDHS) released the draft regulations for its Social Equity ownership program. An amended and updated set of rules and regulations was then released by the AZDHS on May 19, 2021. The state will issue 26 Marijuana Establishment Licenses to Social Equity applicants.

An applicant is eligible to apply for a marijuana establishment license if:

  1. One or more of the owners of the applying entity holds at least 51% ownership in the entity; and
  2. Is currently an Arizona resident and has been an Arizona resident for at least three of the past five years; and
    1. Meets three of the following five criteria:
      1. Had a household income in at least three of the previous five years that is less than 400% of the federal poverty level;
      2. Has been adversely affected by the enforcement of previous marijuana laws because the individual:
        1. Is eligible for and has petitioned for expungement pursuant to A.R.S. 36-2862 (arrested/charged for less than two and one-half ounces of marijuana); or
        2. Was convicted of a violation of federal or state law related to marijuana or marijuana paraphernalia, and does not have an excluded felony offenses
    2. Individual related, as one of the following, to another individual who was convicted of a violation of federal or state laws related to marijuana or marijuana paraphernalia:
        1. Spouse;
        2. Surviving spouse
        3. Parent
        4. Child
        5. Sibling
        6. Legal guardian
    1. Has a physical address, and has lived for at least three of the previous five years at the physical address, in a community that has been disproportionately affected by the enforcement of Arizona’s previous marijuana laws; or
    2. Has a certificate of completion of the Department-provided educational training course.

 

The ADHS will be accepting applications for social equity applicants from December 1, 2021 – December 14, 2021.
