New Jersey Cannabis Program Updates

Recreational cannabis in New Jersey was legalized back in 2020 following a 67% approval vote. The governor and legislature had to work out several disagreements, delaying the cannabis legalization date until February, 2021. Recreational sales began a year later in 2022. Today, the industry is booming, with 2024 first quarter sales totaling more than $201 million – a 38% increase from the previous year.

Here are the latest New Jersey cannabis program updates.

New Jersey cannabis laws and background

In 2021, former governor Jon Corzine signed numerous bills into law as he prepared to leave office, including one that permitted the use of medical cannabis for certain conditions. The law permitted the New Jersey health department to establish rules about qualifying illnesses. While patients could not grow their own cannabis, they could visit state-licensed “alternate treatment centers” to acquire medical cannabis. The program had strict limitations with few doctors willing to recommend cannabis to patients. The state was described as having some of the strictest medical cannabis laws at the time.

Years later in 2019, a medical cannabis expansion measure titled the Jake Honig Compassionate Use Medical Cannabis Act passed in the legislature and was signed into law. Among the many changes this law brought, the sales tax on medical cannabis products was phased out and by 2022, the sales tax for medical cannabis was fully repealed.

When recreational cannabis in New Jersey became legal, alternative treatment centers were the first to transition to adult-use sales. Today, the state has more than 120 operational adult-use cannabis dispensaries.

Below are the types of cannabis licenses in New Jersey:

• Class 1 Cultivator License
• Class 2 Manufacturer License
• Class 3 Wholesaler License
• Class 4 Distributor License
• Class 5 Retailer License
• Class 6 Delivery License

Depending on the type of business, some operators are required to obtain multiple types of New Jersey cannabis business licenses in order to be compliant. The state also offers conditional (temporary) and permanent licenses depending on where applicants are in the application process.

New Jersey cannabis market by the numbers

New Jersey cannabis sales totaled more than $800 million in 2023. The state anticipates reaching $1 billion in 2024. In addition to cannabis-specific operations, the state expects cannabis ancillary services to generate $1.5 to $2 billion in taxable revenue for municipalities that have opted in for cannabis operations.

The New Jersey Cannabis Regulatory Commission also reported that dispensaries brought in nearly $12.5 million in sales over the 4/20 weekend alone.

What’s next for cannabis in New Jersey?

The state plans to allow for the opening of cannabis consumption spaces in the near future. While anticipation for these spaces to launch was growing in January, the state appears to have hit a stand-still in the regulatory process. In the Cannabis Regulatory Commission’s article celebrating three years of recreational cannabis posted in April, 2024, regulators noted that next steps for the cannabis consumption areas will be released in the coming months.

In its closing statement, the Cannabis Regulatory Commission stated: “As we celebrate the NJ-CRC’s third anniversary, we must recognize that the journey toward a fully inclusive and equitable cannabis industry is ongoing. Let’s continue to support the NJ-CRC’s mission of fostering an inclusive cannabis ecosystem that prioritizes equity, accessibility, and opportunity for all.
