Medical cannabis legalization passed in Nebraska during the November 2024 election. The Governor signed Emergency Regulations into effect on July 1, 2025.

The initiative enacted the Nebraska Medical Cannabis Regulation Act. The act legalizes the possession, manufacture, distribution, delivery, and dispensing of marijuana for medical purposes. It established the Nebraska Medical Cannabis Commission to regulate and provide the necessary registration for the medical marijuana program. Regulations are to be established by July 1, 2025.

NEBRASKA MEDICAL CANNABIS LICENSES

Cannabis Cultivator License – Cultivator means a registered establishment licensed to cultivate and process cannabis plants for sale and transport to dispensaries, product manufacturers, and to other cultivators, but cannot transfer cannabis plants or cannabis products to qualified patients or caregivers.

Nebraska will be issuing:

  • 4 Cultivator Licenses

Cannabis Product Manufacturer License – Product Manufacturer means a registered establishment license to process cannabis, conduct extractions, and manufacture cannabis products for sale or transfer to dispensaries, but cannot sell or transfer cannabis plants or cannabis products to qualified patients or caregivers.

Nebraska will be issuing:

  • 12 Product Manufacturer Licenses 

Cannabis Dispensary License – Dispensary means a registered establishment licensed to possess, sell or transfer medical cannabis to qualified patients or caregivers.

Nebraska will be issuing:

  • 12 Dispensary Licenses 

Cannabis Transporter License – Transporter means a registered establishment licensed to transport cannabis, cannabis products, and cannabis accessories between medical cannabis licensees, provide logistical services for medical cannabis licensees, or store cannabis.

Nebraska will be issuing:

  • 12 Transporter Licenses
