STATE STATUS

The state of North Dakota legalized medical cannabis in 2016, through a Ballot, Measure 5, which provided a legal way for qualifying patients in the state to access and utilize medical cannabis as a form of treatment for their ailment. Access to medical cannabis is through state licensed businesses that are allowed to grow, manufacture and sell medical cannabis.

NORTH DAKOTA MARIJUANA BUSINESS LICENSES

North Dakota Medical Cannabis Manufacturers – can grow medical cannabis plants; extract, process and produce medical cannabis products; and sell wholesale to state licensed dispensaries. There is a limit of two (2) business licenses allowed for North Dakota Cannabis Manufacturers within the state. 

North Dakota Medical Cannabis Dispensariescan purchase medical cannabis from licensed manufacturers and dispense medical cannabis to registered patients. There is a limit of eight (8) business licenses allowed for North Dakota Medical Cannabis Dispensaries within the state.

HOW TO START A MARIJUANA BUSINESS IN NORTH DAKOTA

To obtain a marijuana business license in North Dakota, you will be required to submit an application. As part of the application, some of the plans you will need to include the following:

  • Security Plan.
  • Environmental Impact Plan.
  • Quality Control and Quality Assurance Plan.
  • Business History Plan.
  • Financial Plan.
  • Community Benefits Plan.
  • Research Plan.
  • Cultivation, Manufacturing and/or Dispensing Plan.
  • Labor Compliance Plan.
  • Staffing and Training Plan.

NORTH DAKOTA RECREATIONAL CANNABIS ON THE BALLOT

The North Dakota Marijuana Legalization Initiative is on the ballot in North Dakota as an initiated state statute on November 8, 2022. This measure would legalize the personal use of marijuana for adults 21 and older and allow individuals to possess up to one ounce of marijuana and grow up to three marijuana plants. The measure would require the Department of Health and Human Services, or another department or agency designated by the state legislature, to establish an adult-use marijuana program and regulate the production and distribution of adult-use marijuana by October 1, 2023. Under the measure, the department could license seven cultivation facilities and 18 marijuana retailers.

Types of Adult-Use Marijuana Business

Dispensary – an entity registered by the department as an adult-use cannabis business authorized to sell adult-use cannabis products.

Manufacturing facility – an entity registered by the department as an adult-use cannabis business authorized to produce and process cannabis and to sell adult-use cannabis products to a dispensary.
