STATE STATUS
The state of Oklahoma legalized medical cannabis in 2018, through a Ballot Measure, Oklahoma State Question 788, which provided a legal way for qualifying patients in the state to access and utilize medical cannabis as a form of treatment for their ailment. Access to medical cannabis is through state licensed businesses that are allowed to grow, manufacture and sell medical cannabis.

NUMBER OF MARIJUANA BUSINESS LICENSES AVAILABLE
Medical marijuana business licenses are available in Oklahoma. The number of marijuana business licenses available are subject to each local municipality (city, township, borough, county) and its local ordinances. Local governments will be allowed to regulate the number and types of licenses allowed to operate within their jurisdiction. Types of licenses allowed include the following:
Oklahoma Medical Marijuana Grower License Information: a licensed commercial grower can sell marijuana to a licensed retailer or a licensed processor; and there are no limitations on how much marijuana a licensed grower can grow.
Oklahoma Medical Marijuana Processor License Information: a licensed processor can take marijuana plants and process these plants into other forms for consumption. Additionally, a licensed processor may sell marijuana products to a licensed retailer or any other licensed processor.
Oklahoma Medical Marijuana Dispensary License Information: a licensed dispensary can sell marijuana plants or marijuana products in the form provided by licensed processors. The products can only be sold to an Oklahoma medical marijuana patient or their caregiver.

To obtain a marijuana business license in Oklahoma, you will be required to submit an application. As part of the application, you will be required to submit marijuana business plans such as the following:

- Financial Plan
- Cultivation, Production, and/or Dispensing Plan
- Inventory Control Plan
- Security Plan
- Recordkeeping Plan
- Patient/Customer Education Plan
- Community Benefits Plan

ENHANCED OVERVIEW OF MARIJUANA IN OKLAHOMA
Oklahoma voters approved Question 788, in 2018, legalizing medical marijuana in Oklahoma. The new law also allows for the licensing of medical marijuana businesses to include growers, processors and dispensaries. The Oklahoma State Department of Health, a newly assembled Medical Marijuana Commission, and the Alcoholic Beverage Laws Enforcement Commission are responsible for regulating the medical marijuana program, which includes developing rules and regulations, awarding grower/dispensary licenses, processing patient license (cards), etc.
The Department of Health made applications for medical marijuana business licenses available on August 25, 2018 without a deadline for submission. Once the application has been submitted, it will be reviewed and deemed incomplete/complete. If complete, an approval letter with the identification card will be mailed within 14 days of the application submission date.
The regulating agency is taking steps to implement statutory changes made during the 2019 legislative session to the state’s current medical marijuana program. All program changes were implemented in Q4 of 2019, and will be followed by permanent rules in 2020.
