The state of Texas legalized low-THC, high-CBD medical cannabis in 2015, through a Legislative bill, Senate Bill 339, which provided a legal way for qualifying patients in the state to access and utilize low-THC, high-CBD medical cannabis as a form of treatment for their ailment. Access to medical cannabis is through state licensed businesses that are allowed to grow, manufacture and sell low-THC, high-CBD medical cannabis.
When to Apply
TYPES OF BUSINESS
Texas Medical Cannabis Dispensing Organization – a vertically integrated license, allowing a licensee to grow medical cannabis plants; extract, process and produce low-THC, high-CBD medical cannabis products; and dispense to registered patients. There are no state-wide limits on number of dispensing organization licenses available, however the state has stopped accepting applications for business licenses.
HOW TO START A CANNABIS BUSINESS IN TEXAS
To obtain a marijuana business license in Texas, you will be required to submit an application. As part of the application, some of the plans you will need to include the following:
- Security Plan.
- Environmental Impact Plan.
- Quality Control and Quality Assurance Plan.
- Business History Plan.
- Financial Plan.
- Community Benefits Plan.
- Research Plan.
- Cultivation, Manufacturing and/or Dispensing Plan.
- Labor Compliance Plan.
- Staffing and Training Plan.

2018 – First Texas medical cannabis businesses opened and low-THC, high-CBD medical cannabis products sales began
October 1, 2019 – Department opened the application process for additional Dispensing Organization licenses
October 9, 2019 – Department unexpectedly closes applications
January 16, 2023 – Department reopens application process for additional Dispensing Organization licenses
