STATE STATUS
Rep. Jake Wheatley’s bill to end cannabis prohibition — HB 2050 —would replace the unregulated illicit market with a taxed and regulated system with licensed growers, processors, and retailers. It includes a robust clean slate program — including release from incarceration. Tax revenue would primarily be used for student loan reimbursement, Pennsylvania’s mixed-income housing program, after school programs, and for a cannabis grant program minorities and women.
The state of Pennsylvania legalized medical cannabis in 2016, through a Legislative bill, Senate Bill 3, which provided a legal way for qualifying patients in the state to access and utilize medical cannabis as a form of treatment for their ailment. Access to medical cannabis is through state licensed businesses that are allowed to grow, manufacture and sell medical cannabis.

PENNSYLVANIA PROPOSED ADULT-USE MARIJUANA BUSINESS LICENSES
Pennsylvania Cannabis Grower– can grow cannabis plants, dry, cure, package, process cannabis products, and sell wholesale to other licensed Pennsylvania Cannabis Businesses. There is a limit of fifty (50) business licenses allowed for Pennsylvania Cannabis Growers within the state.
Pennsylvania Cannabis Dispensary – can purchase cannabis from licensed grower/processor facilities and dispense cannabis to clients over the age of 21. There is a limit of one hundred (100) business licenses allowed for Pennsylvania Cannabis Dispensaries within the state.
Pennsylvania Cannabis Processor – can purchase cannabis from licensed grower facilities and process, extract, and produce cannabis products. There is a limit of fifty (50) business licenses allowed for Pennsylvania Cannabis Processors within the state.
PENNSYLVANIA MEDICAL MARIJUANA BUSINESS LICENSES
Pennsylvania Medical Cannabis Grower/Processor – can grow medical cannabis plants; extract, process and produce medical cannabis products; and sell wholesale to other licensed Pennsylvania Medical Cannabis Businesses. There is a limit of twenty-five (25) business licenses allowed for Pennsylvania Medical Cannabis Grower/Processor within the state.
Pennsylvania Medical Cannabis Dispensary – can purchase medical cannabis from licensed grower/processor facilities and dispense medical cannabis to registered patients. There is a limit of fifty (50) business licenses allowed for Pennsylvania Medical Cannabis Dispensaries within the state. Each Dispensary Licensee is allowed to operate up to three (3) stand-alone dispensaries.
HOW TO OPEN A MARIJUANA BUSINESS IN PENNSYLVANIA
To obtain a marijuana business license in Pennsylvania, you will be required to submit an application. As part of the application, some of the plans you will need to include the following:
- Security Plan.
- Environmental Impact Plan.
- Quality Control and Quality Assurance Plan.
- Business History Plan.
- Financial Plan.
- Community Benefits Plan.
- Research Plan.
- Cultivation, Manufacturing and/or Dispensing Plan.
- Labor Compliance Plan.
- Staffing and Training Plan.

Program Timeline:
2016 – Pennsylvania legalized medical cannabis
2017 – Pennsylvania licensing period for cannabis businesses (Phase 1)
Jan 2018 – First Pennsylvania medical cannabis businesses opened and medical cannabis sales began
May 2018 – Pennsylvania reopened licensing period for cannabis businesses (Phase 2)
