Federal Marijuana Rescheduling Possibly Coming Soon
Trump Reportedly Nearing Federal Marijuana Rescheduling
Recent reports indicate that President Donald Trump is considering rescheduling marijuana under federal law, a move that could significantly reshape the U.S. cannabis industry.
According to Marijuana Business Daily, citing reporting from The Washington Post, President Trump is weighing an executive order that would reclassify marijuana from Schedule I to Schedule III under the Controlled Substances Act. Schedule I substances are defined as having no accepted medical use and a high potential for abuse, while Schedule III drugs are considered to have accepted medical uses and lower abuse potential.
While rescheduling would not legalize cannabis at the federal level, it could ease restrictions on scientific research, reduce regulatory burdens, and provide major financial relief to licensed cannabis operators. Most notably, Schedule III status could allow cannabis businesses to claim standard tax deductions currently prohibited under IRS Code Section 280E.
The report suggests that Trump discussed the issue during conversations with House Speaker Mike Johnson, with cannabis industry executives present. However, White House officials have emphasized that no final decision has been made, and any policy shift would still require coordination with federal agencies such as the Drug Enforcement Administration.
The potential change has already had ripple effects across the market, with cannabis stocks reacting positively to the news. Industry advocates argue that rescheduling would better align federal law with the reality that the majority of U.S. states have legalized marijuana for medical or adult use.
If enacted, rescheduling marijuana to Schedule III would represent one of the most consequential federal cannabis policy changes in decades, signaling a significant shift in the federal government’s approach to marijuana regulation.
