Florida begins 2026 with renewed attention on the potential of an adult-use marijuana program, as advocates work to return a recreational legalization amendment to the statewide ballot in November 2026. The effort follows the 2024 election, when a majority of Florida voters supported legalization but the measure did not reach the 60 percent approval threshold required to amend the state constitution.

To qualify for the 2026 ballot, supporters must collect at least 880,062 valid voter signatures by February 1, 2026. Organizers have indicated confidence in meeting that requirement, citing revisions to petition language and validation processes after earlier efforts encountered technical challenges.

If approved by voters, the proposed amendment would allow adults aged 21 and older to legally possess and use marijuana under Florida law. The proposed framework would not permit public smoking or vaping and would include safeguards designed to limit youth exposure, including restrictions on marketing and packaging that could appeal to children.

Before appearing on the ballot, the proposal must also undergo review by the Florida Supreme Court to confirm that it meets constitutional standards and accurately reflects its purpose to voters. This legal review is a required step in Florida’s ballot initiative process and may influence final timing and ballot eligibility.

Florida already operates one of the largest medical marijuana programs in the United States, approved by voters in 2016. The state’s medical framework is vertically integrated, with an established network of licensed operators and statewide dispensary access that could inform future discussions around adult-use implementation.
