Florida Cannabis Program Updates

Despite years of failed attempts to legalize recreational cannabis in Florida, the Sunshine State still prohibits its use. In April 2024, the Florida Supreme Court ruled that, despite the Attorney General’s urgings to remove the initiative from the ballot, the latest initiative to legalize recreational cannabis is constitutional. As a result, Amendment 3 will remain on the ballot and, if approved, it will legalize adult-use cannabis in Florida.

Building off the well-established medical market

Florida has already brought in around $2 billion in annual medical sales from its more than 600 dispensaries serving more than 800,000 patients.

 

The proposed legislation would allow existing medical cannabis dispensaries to begin selling adult-use cannabis. It also allows, but does not require, the legislature to approve the addition of more dispensaries.

 

According to a fiscal impact statement by the Florida Financial Impact Estimating Conference, adult-use cannabis sales are projected to generate at least $195.5 million annually in state and local sales tax revenues. Headset estimates first-year sales to reach between $4.9 billion to $6.1 billion.

Recent developments for Florida cannabis

Earlier polls reported voter support for recreational cannabis to be just below the required 60% to pass. While we can’t say for certain yet, more recent polls indicate that Florida is likely to pass this upcoming adult-use cannabis legislation.

 

Recent reports from Florida Politics show that nearly two-thirds of Florida voters approve of the upcoming recreational cannabis initiative. The survey indicated that 64% of 1,065 likely voters would vote yes for adult-use cannabis, with 100% support from respondents aged 18 to 29. Additionally, a separate Fox News poll showed support from 66% of voters in favor of the legislation.

 

The future of recreational cannabis in Florida

We will have to wait and see how Amendment 3 fares on the November ballot. Though recent polling suggests it’s likely to pass, it’s not a guarantee.

 

If Amendment 3 does pass, the state will need to build out an infrastructure to regulate the adult-use market. It will likely take some time before the existing medical cannabis dispensaries begin to serve adult-use customers. If the state decides to allow the launch of more recreational cannabis dispensaries, there will likely be an interim period where the only retailers serving adult-use cannabis are existing medical dispensaries.
