Legal Victory Boosts 2026 Marijuana Ballot Push in Florida
The Florida Marijuana Legalization Initiative (2026), spearheaded by Smart & Safe Florida, aims to amend the state constitution to legalize non-medical marijuana for adults 21 and older. Key features include restrictions on marketing/packaging that appeal to children, bans on public smoking or vaping, possession limits, maintaining laws against driving under the influence, and licensing of non-medical marijuana businesses.
To qualify, the initiative needs 880,062 valid signatures statewide, plus signatures meeting 8% of voters in at least half of Florida’s congressional districts. As of the latest count, the campaign has gathered over 75% of that number.
The campaign is also challenging parts of a state law (HB 1205) that restricts signature gathering barring non-residents and non-U.S. citizens from collecting or delivering ballot petitions. A federal judge, Mark Walker, ruled that those specific restrictions violate the First Amendment and are blocked, because they pose a “severe burden on political expression.”
Some parts of that law remain in effect, though, meaning there are still legal hurdles for the petition-drive process.
