Nebraska Licensing Opportunity – Emergency Cannabis Regulations: What You Need to Know
On June 29, 2025, Governor Jim Pillen approved emergency regulations to jumpstart Nebraska’s medical cannabis program, following the passage of Measure 438. These temporary rules are in effect for 90 days and are designed to establish the groundwork for licensing, which, per regulations, must begin by October 1, 2025.
Background: How We Got Here
Before the emergency regulations were adopted, Nebraska voters approved medical cannabis at the ballot box in November 2024. To keep the program on track, the state implemented short-term rules on June 29. These emergency measures are critical for getting the program off the ground ahead of the full regulatory rollout this fall.
What’s Included in the Emergency Rules
The emergency regulations cover a lot of ground, from who can own a cannabis business to where those businesses can operate and what types of products are allowed. Here’s a closer look at the key regulatory highlights:
- Licensing
- Available Licenses:
- Cultivation Licenses: 12
- Product Manufacturer (Processing) Licenses: 12
- Dispensary Licenses: 12
- Transporter Licenses: 12
- Vertical integration is prohibited, so companies must choose a single license type.
- Licenses are valid for two years, non-transferable, and require active operation for renewal.

- Background Checks and Eligibility
- At least 51% ownership must be held by Nebraska residents who have lived in-state for at least four years and are U.S. citizens.
- Prohibitions apply to individuals with any felony or controlled-substance conviction in the past 10 years.
- Zoning and Location Rules
- Only one license per type (dispensary, cultivator, manufacturer, transporter) is allowed in each of Nebraska’s 12 judicial districts.
- Licensed facilities must be located at least 1,000 feet from schools, daycares, churches or hospitals.

What Happens Next?
The public comment period ends July 15, 2025. Feedback will inform permanent rulemaking later in the summer. In addition, formal regulations are due by October 1, 2025, when the Commission must begin issuing licenses.
