2022 Mississippi Medical Cannabis Legalization
Medical marijuana for certain patients with debilitating conditions is now legal in Mississippi after the state’s Republican governor, Tate Reeves, signed a bill into law on Wednesday.
Mississippi is the 37th state to legalize the medical use of cannabis. While most voters approved a Mississippi medical cannabis initiative in November 2020, it was annulled by the state Supreme Court six months later.
The new law will permit patients to purchase up to 3.5 grams of cannabis per day, six days a week. It also prevents economic development incentives for the cannabis industry from the state.
License types that will be available include:
- Cannabis cultivation facilities
- Cannabis processing facilities
- Cannabis dispensaries
- Cannabis testing facilities
- Cannabis waste disposal entities
- Cannabis transportation entities
The state is not limiting the number of licenses statewide and, in turn, allows local municipalities to regulate cannabis businesses within their jurisdiction. Cities and counties have 90 days to opt-out of allowing medical cannabis facilities for growing or selling.
The application process is set to begin in June 2022, with a 30-day approval time for licensure applications. The state will accept and review applications on a rolling basis.
