Arizona Court Rules Marijuana Initiatives Can Be on November 2020 Ballots

On August 7, 2020, Maricopa County Superior Court Judge James Smith rejected challenges to two proposed voter initiatives: one implementing criminal sentencing reform and the other legalizing recreational marijuana. A local anti-marijuana group claimed the 100-word summary deceived the people who signed the petitions. However, Smith announced that the Smart and Safe Act ballot initiative to legalize recreational marijuana for adults 21-years and older did not deceive voters, as claimed by the local anti-marijuana group.
The 15-page ruling released on August 7 mentioned that “At 100 words, the summary also cannot include everything. That is why the full initiative must accompany the petition.” Smith also addressed the opponents’ suggestions that voters might not understand all the implications of the measure, such as changing laws on advertising and driving under the influence of drugs, Tucson.com reported.
Early last month, the initiative submitted roughly 420,000 signatures, 180,000 more than the state-required, to the Secretary of State. Smith emphasized that it is up to voters to decide if an initiative is good or bad. Many of the objections from the opposition are “policy issues best left for voters or elected representatives.”
* Update as of August 14, 2020, the Smart and Safe Act initiative will appear on the November ballot as Prop 207. Prop 207, which aims to legalize cannabis for adult-use in Arizona, has officially been approved by Secretary of State Katie Hobbs. View the entire initiative here.
