Inside South Carolina’s Medical Marijuana Framework: Licensing Opportunities Under SB 53

South Carolina continues to advance discussions around a regulated medical cannabis program through Senate Bill 53, known as the South Carolina Compassionate Care Act. The proposed legislation would amend the South Carolina Code of Laws to allow the sale of cannabis products for therapeutic use and establish the conditions under which those sales could occur, creating a structured statewide medical marijuana framework. Currently, South Carolina operates under a limited medical framework through Julian’s Law, which allows access to low-THC, high-CBD cannabis products for certain qualifying patients. SB53 would build on that existing foundation by establishing a comprehensive medical cannabis program with regulated licensing, expanded product categories, and statewide patient access.

If enacted, SB53 would authorize a full medical cannabis supply chain with clearly defined license categories. The bill outlines a framework that includes up to fifteen cannabis cultivator licenses permitting the cultivation of cannabis plants, testing of unprocessed products, and wholesale distribution to other licensed establishments. It also proposes up to thirty processor licenses for businesses manufacturing medical cannabis products such as edibles and oils, packaging products, and distributing them wholesale. In addition, the program would include up to one hundred thirty-eight therapeutic cannabis pharmacy licenses for retail sales to qualified patients and caregivers, along with up to four transporter licenses and up to five testing facility licenses to support product movement and compliance.

The Department would implement a competitive, scored application process with separate application tracks for independent operators and integrated businesses. Additional points would be awarded to applicants with established agricultural, manufacturing, or hemp operations in South Carolina for at least two years, as well as to applicants whose ownership is majority South Carolina residents. In jurisdictions where local participation limits applications, evaluations would also consider location suitability and patient accessibility, applicant background and experience, and the strength of the proposed business plan, including supply continuity, security, diversion prevention, and plans to make products accessible to low-income patients.

Application requirements under SB53 are comprehensive and would include a nonrefundable application fee, proof of sufficient capitalization, financial disclosures, zoning compliance documentation, background checks for principals, operational and security plans, and documentation demonstrating technical qualifications relevant to each license type. Applicants seeking multiple licenses would be required to disclose all license categories applied for as part of the submission.

The bill remains in the legislative process during the 2025–2026 session, with program timing dependent on passage. SB53 reflects continued efforts to refine a regulatory structure designed to meet legislative standards while expanding patient access within a controlled medical framework.
