No legislation
Nebraska: McKinney and fellow Democrat Justin Wayne have also proposed bills that would
legalize marijuana use and regulate its production and distribution.
The question of legalizing marijuana could appear on the November ballot after a petition effort
turned in nearly 115,000 signatures to state election officials in July — more than the 87,000 or
so needed. The Nebraska Secretary of State's Office is in the process of verifying the signatures.
Lawmakers expected to debate a version of the governor's proposal throughout the week.

Medical
North Dakota: Thanks to New Economic Frontier, a North Dakota advocacy group for
legalization, this measure has been added to the ballot this year. If approved by voters, it will
legalize the use, home cultivation and retail sale of cannabis products no later than October 1,
2025. Industry leaders are applauding the measure and expressing considerable optimism that
cannabis will be legalized in North Dakota.
The Secretary of State’s Office announced Monday it has approved the recreational marijuana
measure for the November ballot after verifying nearly 19,000 signatures of people who signed
onto the petition, more than the 15,582 required by law. Casey Neumann, chief operating officer
for Pure Dakota Health, said the company donated to the initiative because officials see the
potential for recreational marijuana in North Dakota as a net-positive for the state’s medical
marijuana industry.

California: California senators have advanced an Assembly-passed bill that would allow regulators to issue a new license allowing small marijuana growers to sell their products directly to consumers at state organized farmers markets and other temporary events. The legislation from Assemblymember Gail Pellerin (D) was unanimously approved in the Senate Appropriations Committee in a 4-0 vote on Thursday. Adults would also be able to consume cannabis on-site at approved events. The bill cleared the Assembly in late May with nearly unanimous support before moving to the Senate, where it passed through two committees. It now heads to the floor. Under the proposal, the Department of Cannabis Control (DCC) would be authorized to issue “a state temporary event license to a licensee authorizing onsite cannabis sales to, and consumption by, persons 21 years of age or older at certain venues expressly approved by a local jurisdiction, as specified,” the bill text says.
Applicants wishing to obtain the state temporary events license would also need to meet the
definition of a small marijuana producer. That means they could not be cultivating more than one
acre of cannabis, 22,000 square feet under a mixed-light tier 1 cultivation license or 5,000 square
feet under a mixed-light tier 2 or indoor cultivation license.

At State-Run Farmers Markets – Marijuana Moment
Delaware: Delaware officials are now officially accepting applications for the state’s first adult-
use marijuana business licenses, weeks ahead of schedule. In fact, Friday’s launch comes days in
advance of an already-shortened timeline that regulators had put forward earlier this month. The
deadline to submit applications is September 30, with eligible submissions then being entered
into a lottery set to take place in late October. Licenses will be issued to the winners beginning in
November.
