Alabama: Alabama’s Alcohol Beverage Control Board voted 2 to 1 to adopt an emergency rule regulating consumable hemp products, creating a new program that allows the state to fine or penalize businesses selling unapproved items. The rule moves forward despite objections from Rep. Andy Whitt, the sponsor of the underlying hemp law, who argues the board exceeded its authority.
“I’m opposed to it only because I have a problem with the way it was done,” Knight said.
The rule is temporary and is meant to bridge the gap until broader hemp regulations approved by lawmakers take effect in 2026.
Florida: A proposed recreational marijuana constitutional amendment in Florida has now officially been sent to the Florida Supreme Court for review after supporters submitted enough signatures to trigger the process, meaning voters could get another chance to weigh in on legalizing adult‑use cannabis. Supporters must still gather 880,062 valid signatures by February 1, 2026, for the measure to qualify for the November ballot. The court will review the proposal’s language and structure before it can move forward.
Pennsylvania: Pennsylvania is considering legalizing recreational marijuana, with lawmakers and the governor actively debating proposals for adult-use cannabis. The state’s House of Representatives has passed legalization bills, and the governor has repeatedly expressed support for reform.
However, progress has stalled in the Republican-controlled Senate, and no final legislation has been approved yet. As a result, adult-use marijuana is not guaranteed to become legal next year, although efforts continue as supporters push for compromise and a path forward.

Delaware: Lawmakers in the House of Representatives are debating House Bill 252, a proposal that would change how public marijuana use is penalized by reclassifying the use or consumption of a personal-use amount of marijuana. The bill aims to adjust penalties currently associated with public marijuana consumption under existing state law.
Under current Delaware law, adults 21 and older can possess a personal use quantity without criminal penalties, but public use is still considered a misdemeanor with fines and possible jail time. The new bill could reduce or restructure those penalties, reflecting ongoing refinement of the state’s marijuana policy as adult-use legalization continues to be implemented.
New Jersey: A new bill targeting hemp products is close to final passage in the Legislature as lawmakers respond to recent changes in federal hemp definitions that would otherwise make many products illegal. The measure would set state limits on THC in hemp products, require businesses to sell off non‑compliant inventory by specified deadlines in 2026, and treat products exceeding those limits as cannabis subject to licensing by the state’s Cannabis Regulatory Commission. Supporters say the bill will protect public health, especially for young people, while some hemp farmers argue it could harm smaller producers.
