Medical
Alabama: Alabama may have reached a settlement with license applicants. The settlement, if ratified by the AMCC at a meeting scheduled for November 27, would allow the commission to move forward with its new timeline in an attempt to issue licenses for most of the categories in the medical cannabis production process by the end of the year, it’s third attempt to do so after the first two failed.
According to sources, the terms of the settlement include:
– Throwing out the controversial scores of the original applications generated by evaluators hired by the University of South Alabama who administered the scoring system under contract from the AMCC, and instructing the commission not to consider them in their new license-awarding process
– Dismissing the lawsuits based on the questions about those scores as well as multiple issues with the instructions given to applicants about how to apply and how big the file size limit was for attachments to their online applications
– Applicants in all of the categories except for the integrated licensing category can resubmit videos and briefing materials before the commission begins a new round of discussions an licenses for those categories
Hawaii: Hawaii’s attorney general has released a comprehensive proposal to legalize adult-use marijuana—with lawmakers already expressing interest in advancing it as advocates call for revisions to bolster equity provisions and remove language that could perpetuate criminalization. Under the proposal, a regulatory framework would be established to allow adults 21 and older to possess, cultivate and purchase marijuana from licensed retailers.
Pennsylvania: The Pennsylvania House of Representatives has approved a Senate-passed bill to allow all licensed medical marijuana grower-processors in the state to sell their cannabis products directly to patients.
South Dakota: South Dakota’s attorney general issued a draft explanation on Friday for a second proposed ballot measure to legalize recreational marijuana in the state. Unlike a separate would-be initiative filed earlier this year, the new proposal includes plans for licensed, regulated retail sales to adults in addition to legalizing possession and home cultivation. The Department of Health would be authorized to issue dual-use licenses to existing medical marijuana dispensaries to begin adult-use sales. Local governments couldn’t prohibit dual-use licensees entirely, but they could limit the number of licenses available within their jurisdictions.
Recreational
Ohio: Ohio’s Senate president says he is working with bipartisan lawmakers in both chambers to quickly develop and pass legislation to revise the state’s voter-approved marijuana legalization law before key provisions take effect next month, arguing that it’s what “the public generally wants” because voters likely didn’t think through the specifics of the reform they authorized.
