No Legalization States
Kansas: State lawmakers discussed the legality of intoxicating hemp-THC products, as Kansas remains without legalized medical/recreational cannabis.
Robert Stuart, executive officer for the Kansas Bureau of Investigation, testified that while marijuana is illegal in Kansas, THC-infused beverages are considered hemp products and allowed under federal law. He emphasized the need for clear state regulations, stating, “If it’s intoxicating, it’s damaging,” and suggested that outlawing such products would provide clarity for consumers, retailers, and law enforcement.

Low-THC, High-CBD States
Georgia: In Georgia, lawmakers are preparing to debate a major expansion of the state’s medical-marijuana program during the next legislative session through proposed Senate Bill 220, which would permit vaping and raise THC limits from 5 % up to 50 %.
Wisconsin: Wisconsin’s Senate Health Committee recently held a hearing on a GOP-led bill to legalize medical marijuana. The proposal includes provisions for patient and caregiver registrations, dispensaries employing pharmacists, and a ban on smokable cannabis.
It also establishes parental rights and housing discrimination protections but allows employers to fire or refuse to hire workers based on medical marijuana use. The bill is expected to advance quickly, with a potential vote in November.
Medical
Kentucky: A bipartisan coalition of 39 state and territory attorneys general has called on Congress to close the loophole in the Agriculture Improvement Act of 2018 (the “2018 Farm Bill”) definition of “hemp” by clarifying that all intoxicating hemp-derived THC products are illegal to sell or manufacture.
Pennsylvania: A bill (Senate Bill 49) has advanced in the full state Senate which would create a new “Cannabis Control Board” and bring the medical marijuana program under its oversight, while also tightening regulation of hemp-derived THC products.
Adult-Use States
California: A new bill in California, Assembly Bill 564, is headed to Governor Gavin Newsom’s desk after winning strong legislative support: the law would roll back the state’s cannabis excise tax from 19 % back to 15 % and lock that rate in through June 2028.
Ohio: The State House passed a bill that makes substantial changes to the voter-approved adult-use cannabis law and adds regulatory control over “intoxicating hemp” products (such as delta-8/delta-10); including requiring sales via licensed dispensaries, imposing age restrictions, testing and labeling requirements, and overall tighter limits.
