Recreational cannabis in Maine has been legal since voters approved a measure in 2016. The bill became law in 2018 after the state legislature overturned the Maine governor’s attempt at a veto, citing conflicts with federal law. Today, the state has more than 200 operational dispensaries.
Current Maine cannabis laws allow for small amounts of home-grown cannabis in private residences as well as commercial cultivation and sale of the plant.
Municipalities must choose to opt in for commercial cannabis sales. While many areas have opted in, many more municipalities across Maine have chosen not to opt in to adult-use cannabis.
Maine cannabis overview
As of September 2024, there are 132 cultivators, 104 manufacturers, 230 retailers, and four testing labs across the state.
Retail sales in 2023 totaled more than $216 million. So far in September 2024, the total sales for Maine cannabis are at more than $161 million.
Maine’s Office of Marijuana Policy notes the following numbers of municipalities that have opted in:
- Retail – 51
- Cultivation – 93
- Products Manufacturing – 59
- Marijuana Testing Facilities – 58
- Total Municipal Opt-ins – 96
However, there is no rule requiring newly opted-in municipalities to notify the Office of Marijuana Policy. Therefore, it’s likely that the numbers are higher than officially reported.
A closer look at opt-ins
A notable recent opt-in comes from Augusta, the capital city of Maine. Last month, city counselors voted 5-1 in favor of opting-in for recreational cannabis businesses. Prior to the vote, only medical cannabis businesses were allowed to operate in the state’s capital city.
According to Cannabis Business Times, about 83% of municipalities in Maine prohibit recreational cannabis sales. Municipalities are opted out by default and must vote to opt in.
Growth potential for Maine cannabis
Even though the majority of the state’s municipalities do not allow for recreational cannabis sales, the state has brought in a lot of money from cannabis (See above overview for more details.)
Apart from the potential growth if more municipalities opt in to recreational cannabis businesses, the state is also eyeing the potential to open cannabis consumption lounges.
“The charge is to examine opportunities for hospitality-related business activities in the state’s adult use program,” said John Hudak, director of the state Office of Cannabis Policy, recently.
