Virginia Adult-Use Cannabis Update
The Virginia Senate voted to speed up the timeline on adult-use marijuana sales, making it possible for existing medical dispensaries to begin adult-use sales this September.
Medical marijuana was legalized in Virginia in 2018, allowing for low-THC, high-CBD medical cannabis sales. The first Virginia medical cannabis processors were anticipated to open in 2020.
While the legal market for adult-use cannabis sales will not officially open until 2024, the bill will allow consumers to purchase cannabis without a prescription from existing medical dispensaries if Governor Glenn Youngkin signs it.
Virginia initially passed a law allowing adult-use marijuana in April 2021, making it the sixteenth state to legalize it. Access to cannabis will be through state-licensed marijuana businesses. The deadline for regulations is set for July 2023.
The dates for business license applications have not yet been made available; however, social equity applications are expected to begin between July and December of 2023.
The types of licenses available include:
- Marijuana Cultivation Licenses
- Marijuana Manufacturing Licenses
- Marijuana Testing Facility Licenses
- Marijuana Wholesaler Licenses
- Marijuana Retail Licenses
The Virginia Cannabis Control Authority will establish a criterion to evaluate new licenses based on the community’s density of retail marijuana stores. Licenses will be limited to 400 retailers, 25 wholesalers, 60 manufacturers, and 450 cultivators.
