Bill Introduced to Legalize Recreational Cannabis in Texas
Legislators have introduced H.B. No. 1208, which would legalize recreational cannabis in Texas, and establish a regulatory framework. The measure would create opportunities for entrepreneurs to enter Texas’s cannabis market, as the bill creates new license types and widens the accessibility for future medical marijuana patients.
Current Medical Marijuana Use
The state of Texas legalized low-THC, high-CBD medical cannabis in 2015, through a Legislative bill, Senate Bill 339, which provided a legal way for qualifying patients in the state to access and utilize low-THC, high-CBD medical cannabis as a form of treatment for their ailment. Additionally, access to medical cannabis is through state-licensed businesses that are allowed to grow, manufacture and sell low-THC, high-CBD medical cannabis.
The Texas Department of Licensing and Regulation only awarded three licenses authorized to sell under this medical marijuana bill despite the state having no limits on the number of dispensing licenses. Since 2017, the application process has been reopened twice, however the number of licenses awarded remains stagnate.
Legalizing Recreational Marijuana in Texas
Under the proposed bill, individual consumers will be limited to possessing 2.5 ounces of cannabis, with a limit of 15g of concentrate. Entrepreneurs will be able to apply for the following license types:
- Cannabis Grower (Cultivator)
- Cannabis Retail Establishment (Dispensary)
- Secure Transporters
- Testing Facilities
Regulations for the application process, licensing fees, and qualifications required for licensure will be promulgated by the Commission.
The proposed bill sets provisions to take effect September 1, 2025 and new regulations added by the act must be implemented by July 1, 2026. The Texas Department of Licensing and Regulation must begin licensing all license types no later than November 1, 2026.
House and Senate Still in Deliberation
This Bill was introduced in the House and has been referred to the Licensing & Administrative Procedures committee. If passed by the House, it will then head to the Senate. The bill is currently 25% of the way through the legislative process. Texas’s regular session is scheduled to conclude on June 2, 2025.
